TCPA Consent Policy

1. Purpose and Scope
Local Garage Door Pro ("Local Garage Door Pro," "we," "us") uses phone calls, text messages, and prerecorded or artificial voice messages to communicate with prospective and existing homeowners about garage door installation, repair, opener, spring, roller, panel, and related services.
This policy explains:
- How we obtain consent to contact you
- What that consent covers
- How you can withdraw it at any time
- How we store and honor your preferences
This policy applies to all calls and text messages placed by Local Garage Door Pro, by our staff, and by any third party acting on our behalf — including independent service providers we connect you with, marketing agencies, lead generation partners, call centers, AI voice agents, and SMS platform providers.
2. Governing Law
We operate under the federal Telephone Consumer Protection Act (47 U.S.C. § 227) and its implementing rules (47 C.F.R. § 64.1200), the FTC Telemarketing Sales Rule, and applicable state telephone solicitation statutes in every state where we conduct business. Where a state law imposes a stricter standard than federal law, we apply the stricter standard.
3. What Consent Means
Prior Express Written Consent (PEWC) is required before we send marketing or promotional calls or texts using an automatic telephone dialing system, an artificial or prerecorded voice, or an AI voice agent. PEWC means a written agreement, signed by you (including electronically under the E-SIGN Act), that:
- Clearly authorizes Local Garage Door Pro to deliver marketing calls and texts to the specific number you provided
- Discloses that we may use automated technology or prerecorded voice
- States clearly and conspicuously that your agreement is not a condition of purchasing any goods or services
Prior Express Consent — a lower standard — applies to non-marketing, transactional communications directly related to a service you have requested. Examples: appointment confirmations, technician arrival windows, service reminders, and billing notices.
We do not blend the two. A transactional message that also promotes a product or offer is treated as a marketing message and requires PEWC.
4. Consent Language Used on Our Forms
The following disclosure appears adjacent to the submit button on every Local Garage Door Pro web form, landing page, and digital request. It is presented in plain, legible type against a contrasting background, and any consent checkbox is unchecked by default:
By clicking [Get matched], I agree that Local Garage Door Pro and its authorized independent service providers may contact me at the phone number and email address I provided — including by automated telephone dialing system, artificial or prerecorded voice, AI-assisted voice agent, and SMS text message — regarding garage door services, quotes, appointments, and promotional offers. I understand that consent is not a condition of purchase. Message and data rates may apply. Message frequency varies. Reply STOP to opt out or HELP for help. I have read and agree to the Privacy Policy, Terms of Use, and TCPA Consent Policy.
5. Scope of Your Consent
When you provide consent, you authorize contact regarding:
- Quotes and estimates for garage door installation, repair, opener, spring, roller, cable, and panel services
- Scheduling, rescheduling, confirmation, and technician dispatch
- Maintenance plan renewals, recurring service reminders, and warranty notices
- Billing, payment, and account servicing
- Promotional offers, seasonal campaigns, and satisfaction surveys
Consent applies to the specific telephone number you provided. If you change or relinquish that number, you agree to notify us so we can update our records.
6. Communication Practices
Calling hours. We place marketing calls and texts only between 8:00 a.m. and 9:00 p.m. in the recipient's local time zone, and observe narrower windows where state law requires.
Frequency. Message frequency varies by campaign and by the services you have requested. We cap marketing contact attempts consistent with applicable state limits.
Identification. Every marketing call identifies Local Garage Door Pro by name at the outset and provides a callback number that is answered during normal business hours.
Charges. Local Garage Door Pro does not charge for text messages. Standard message and data rates from your wireless carrier may apply. Carriers are not liable for delayed or undelivered messages.
7. How to Withdraw Consent
You may revoke consent at any time, through any reasonable method. We do not require you to use a specific form, script, or channel. Accepted methods include:
- Text: Reply STOP, QUIT, END, CANCEL, UNSUBSCRIBE, OPT OUT, or REVOKE to any message you receive from us
- Voice: Tell any Local Garage Door Pro representative, on any call, that you wish to stop receiving calls or texts — including by saying so to an automated or AI system

What happens next. We will send a single confirmation message acknowledging your opt-out within five minutes. That confirmation contains no marketing content. We will process your revocation and stop the relevant communications no later than ten business days after receipt, and in practice we act far sooner.
Revoking consent for marketing does not cancel any active service request. If you have an open request, we may continue to send transactional messages necessary to service it unless you also revoke consent for those.
8. Do Not Call Lists
We maintain an internal Do-Not-Call list and honor requests indefinitely, or for the longer period required by state law. We scrub against the National Do Not Call Registry and against all applicable state DNC registries before every outbound marketing campaign. Our written Do-Not-Call policy is available on request at no charge.
9. Third-Party Lead Sources
Some of the phone numbers we contact are supplied by third-party lead generators, comparison sites, and marketing partners. Local Garage Door Pro requires every such partner, by contract, to:
- Obtain valid prior express written consent that names Local Garage Door Pro in a clear and conspicuous disclosure
- Deliver a complete consent record with each lead, including the consent language displayed, the URL, the timestamp, the IP address, and any session replay or certification token
- Retain and produce that record on demand
- Refrain from purchasing, renting, or re-selling consent obtained under any other seller's disclosure
We do not accept leads sourced from aggregated "consent farm" pages that list dozens or hundreds of unrelated partner names behind a hyperlink, regardless of how the disclosure is technically constructed.
10. Call Recording and Monitoring
Calls to and from Local Garage Door Pro may be recorded or monitored for quality assurance, training, and compliance purposes. Where required by state law, we obtain all-party consent before recording. If you do not wish to be recorded, tell the representative and we will accommodate the request or continue by another channel.
11. Recordkeeping
We retain consent records — including the exact disclosure text presented, the timestamp, the originating URL or channel, and any revocation — for a minimum of five years from the date of collection or the date of last contact, whichever is later. This exceeds the retention period required in every state in which we operate.
12. State-Specific Provisions
Federal law is the floor, not the ceiling. In states with their own telephone solicitation statutes, we apply the stricter local rule, including but not limited to:
- Florida (FTSA): Prior express written consent for all sales calls and texts; calling window 8:00 a.m.–8:00 p.m. local; no more than three calls on the same subject in any 24-hour period.
- Oklahoma (OTSA): Mirrors FTSA, including the three-call daily cap; scrub against the Oklahoma DNC registry.
- Maryland (Stop the Spam Calls Act): Prior express written consent for telephone solicitations; enhanced consent logging.
- Washington (CEMA): Express written consent for SMS marketing; broad "commercial solicitation" definition applied conservatively.
- Connecticut (Conn. Gen. Stat. § 42-288a et seq.): Prior express written consent for telephonic sales calls; strict frequency and hour limits.
- Virginia (Va. Code § 59.1-510 et seq.): Opt-out requests honored for a minimum of ten years.
- Georgia (O.C.G.A. § 10-1-393.5, as amended by SB 73): Vicarious liability controls applied to all vendors and partners.

14. Changes to This Policy
We may update this policy to reflect changes in law or in our practices. Material changes will be posted here with a revised effective date. Continued communication with us after a change constitutes acceptance of the updated policy for prospective communications only; changes are never applied retroactively to expand the scope of consent you previously granted.
